A Buenos Aires court rejected all appeals in the Diego Maradona death case, paving the way for a second trial in March 2026. The first trial was annulled due to a judge-related scandal.

Appeals in Maradona Death Case Rejected

The Justice of Buenos Aires Province today rejected all appeals filed by the accused in the death of Diego Maradona, thus clearing the way for the start of a second trial, scheduled for mid-March next year. The members of Chamber 3 of the Court of Appeal and Guarantees in Criminal Matters of San Isidro considered the appeals filed by doctor Leopoldo Luque, psychiatrist Agustina Cosachov, nurse Ricardo Almiron and Nancy Forlini, a member of the prepaid health company, to be 'inadmissible'. They also declared the arguments of nurse Carlos Diaz and his superior Mariano Perroni 'abstract'. All those involved, accused of 'simple homicide with eventual intent', had requested to be tried by a jury, as will be the case with nurse Dahiana Madrid. Consequently, and as learned by the Argentine News agency, the second trial will begin on March 17, 2026, as established by the Oral Criminal Court No. 7 of San Isidro. The first trial, for its part, was annulled due to the scandal protagonized by Judge Julieta Makintach, who was dismissed after it was proven that she allowed unauthorized persons to film the different stages of the trial for the death of the former football player. Diego Maradona died on November 25, 2020, from cardiorespiratory arrest secondary to acute pulmonary edema, caused by chronic heart failure, according to the official autopsy.

However, it is presumed that there was medical negligence.
